These Terms and Conditions ("Terms") govern your access to and use of the Tuah Partners website and the engagement of legal services offered by Tuah Partners ("the Firm", "we", "our", "us"), a legal practice registered under the Legal Profession Act 1976 (Malaysia), with offices at Suite 7-1, Menara Tan & Tan, 207 Jalan Tun Razak, 50400 Kuala Lumpur.
By using this website or instructing the Firm, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please refrain from using this website or engaging our services.

1. Definitions
In these Terms, the following words carry the meanings set out below:
- "Agreement" — these Terms and Conditions together with any engagement letter issued by the Firm.
- "Client" — any individual or entity that formally instructs Tuah Partners to provide legal services.
- "Content" — all text, graphics, data, documents, and other material on this website.
- "Services" — the estate planning, trust, and probate legal services provided by the Firm as described on this website.
- "User" — any person who visits or interacts with this website, whether or not they become a Client.
- "We / Us / Our" — Tuah Partners and its legal practitioners and staff.
2. Acceptance of Terms
Use of this website constitutes acceptance of these Terms. To engage the Firm's legal services, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction;
- Have the legal capacity to enter into a binding agreement;
- Provide accurate and complete information when requested.
If you are acting on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
3. Description of Services
Tuah Partners provides estate planning and succession-related legal services in Malaysia, including:
Will Drafting & Testamentary Planning
Preparation of Wills in compliance with the Wills Act 1959, including executor appointments, specific bequests, and guardianship nominations. Fixed fee from RM 550.
Trust Establishment & Administration
Drafting of living, testamentary, and charitable trusts under the Trustee Act 1949, including multi-generational wealth planning arrangements. Fixed fee from RM 1,450.
Estate Administration & Probate
Management of Grant of Probate and Letters of Administration proceedings, asset collection, creditor resolution, and final distribution to beneficiaries. Fixed fee from RM 2,200.
Service availability is subject to jurisdictional suitability. The Firm reserves the right to decline instructions where conflicts of interest, resource constraints, or professional obligations require.
4. Client Engagement
An engagement with Tuah Partners is formalised only upon:
- The Firm issuing a written engagement letter setting out the scope of work and applicable fees;
- Your countersignature or written acceptance of that engagement letter;
- Completion of any mandatory client identification requirements under Malaysian law.
Submission of an enquiry form on this website does not create a lawyer-client relationship. A relationship is established only upon the execution of a formal engagement.
You are responsible for maintaining the confidentiality of any account credentials or reference numbers issued to you for matter tracking purposes.
5. User Responsibilities
When using this website or engaging the Firm's services, you agree to:
- Provide accurate, complete, and up-to-date information at all times;
- Notify the Firm promptly of any changes to information that may affect your matter;
- Not use this website for any unlawful, fraudulent, or malicious purpose;
- Not attempt to disrupt or damage the website or its infrastructure;
- Not reproduce, distribute, or commercially exploit any Content without prior written permission from the Firm;
- Cooperate with all reasonable requests from the Firm relating to your engagement.
The Firm may suspend or terminate access to services where these responsibilities are not met.
6. Intellectual Property
All content on this website — including text, design elements, logos, and legal guides — is the intellectual property of Tuah Partners or its licensors, protected under Malaysian intellectual property law.
You are granted a limited, non-exclusive, non-transferable licence to access and read website content for personal, non-commercial purposes only. This licence does not permit you to:
- Copy or reproduce content for commercial use;
- Redistribute or republish content without attribution and prior written consent;
- Create derivative works based on the Firm's proprietary documents or templates.
Documents and instruments prepared by the Firm specifically for your matter remain your property upon settlement of fees, though the underlying precedents and methodologies remain those of the Firm.
7. Fees and Payment
Fees for the Firm's services are set out in the engagement letter. The indicative fees shown on this website are starting points and may vary depending on the complexity of your matter. All fees are quoted in Malaysian Ringgit (RM).
- Payments are due in accordance with the schedule set out in your engagement letter;
- The Firm accepts payment by bank transfer, cheque, and other methods notified at engagement;
- Disbursements (court fees, stamp duty, registry charges, etc.) are charged separately at cost;
- The Firm will provide itemised billing on request.
Refund Policy: Fees paid for work already commenced are not refundable. Where an engagement is terminated before substantive work begins, the Firm will apply a reasonable assessment of time and resources expended and refund the balance accordingly.
8. Confidentiality
The Firm is bound by professional legal obligations of confidentiality under the Legal Profession Act 1976 and applicable rules of professional conduct. Information shared in the course of your engagement will not be disclosed to third parties without your consent, except where:
- Disclosure is required by law or court order;
- Disclosure is necessary to prevent or detect a criminal offence;
- Disclosure is required by regulatory bodies with lawful authority.

9. Disclaimers

The Firm does not represent or warrant that:

10. Limitation of Liability
To the fullest extent permitted under Malaysian law, Tuah Partners shall not be liable for:
- Indirect, consequential, or incidental losses arising from use of this website;
- Loss of data, revenue, or anticipated savings;
- Losses arising from your reliance on general information published on this website without formal legal engagement;
- Third-party website content accessible via links on this site.
Where liability cannot be excluded by law, the Firm's liability is limited to the fees paid by you for the specific matter in which the loss arose. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot lawfully be excluded.
11. Termination
Either party may terminate an engagement by providing written notice, subject to the terms of the engagement letter. The Firm may terminate an engagement without notice where:
- You have provided false or misleading information;
- Continuing the engagement would place the Firm in breach of professional obligations;
- Fees remain unpaid beyond an agreed period and no resolution is in sight.
On termination, clauses relating to intellectual property, confidentiality, payment of outstanding fees, and dispute resolution shall survive.
12. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Malaysia, specifically the courts of Kuala Lumpur.
Before commencing legal proceedings, you agree to notify the Firm in writing of the dispute and allow 30 days for good-faith resolution. Where the matter relates to professional conduct, complaints may also be addressed to the Malaysian Bar Council.
13. General Provisions
- Entire Agreement: These Terms, together with any engagement letter, constitute the entire agreement between you and the Firm relating to the subject matter herein.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure by either party to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign your rights or obligations under these Terms without prior written consent from the Firm.
- Notices: Formal notices should be sent to the Firm's registered address or to [email protected].
14. Changes to These Terms
The Firm may update these Terms from time to time to reflect changes in our services, legal requirements, or professional obligations. When we make material changes, the "Last Updated" date at the top of this page will be revised.
Your continued use of this website following the posting of updated Terms constitutes your acceptance of those changes. We encourage you to review this page periodically.
