Do I need a Will if I have EPF and insurance nominations?
Yes. EPF nominations and life insurance nominations only govern those specific assets. Your other property — real estate, bank accounts, vehicles, business interests — is distributed according to your Will. Without one, those assets pass under the Distribution Act 1958, which may not reflect your wishes.
How long does the probate process take in Malaysia?
An uncontested Grant of Probate in the High Court typically takes between four and twelve months depending on the complexity of the estate and the responsiveness of financial institutions. Small estates administered through the Land Administrator or Amanah Raya may be resolved more quickly. Our team manages the process on your behalf and keeps you informed at each stage.
What is the difference between a living trust and a testamentary trust?
A living trust (also called an inter vivos trust) takes effect during your lifetime, allowing assets to be transferred directly to beneficiaries without probate. A testamentary trust is created within your Will and only takes effect upon death. Each has distinct advantages depending on your objectives, family circumstances, and asset profile.
Can I update my Will after it is drafted?
Yes. A Will can be updated at any time through a formal codicil or by executing an entirely new Will. We recommend reviewing your testamentary arrangements following major life events — marriage, divorce, the birth of children, or significant changes to your assets. Our team can assist with any necessary amendments.
What documents should I bring for an initial consultation?
A copy of your MyKad and those of your intended beneficiaries is helpful. A general list of your assets — property titles, bank accounts, investments, and vehicle registrations — assists us in providing targeted advice. You do not need formal valuations at this stage. Our priority at the first meeting is to understand your family circumstances and planning objectives.
